What types of cases qualify for a cash advance?

Our only requirements are that:

you have hired an attorney, and

there is insurance or a deep-pocket, self-insured company to pay your damages.

Most of the cases that we fund involve:

      automobile accident injuries, and

      workers' compensation claims.

We also fund cases involving:

      injured seamen or railroad workers,

      product liability (including pharmaceutical drugs),

      airplane crashes,

      construction defects,

      dog bites,

      construction-site liability,

      general premises liability,

      medical malpractice,

      nursing home/elder abuse,

      legal malpractice, and

      other kinds of negligence.

We fund cases involving intentional acts, such as:

      assault and battery,

      sexual harassment, and

      work-related discrimination.

We also fund commercial litigation cases.

Is a lawsuit cash advance a kind of loan?

Our lawsuit advances are not loans, because you have no unconditional personal obligation to repay any money. We want you to understand the difference between a loan and a lawsuit advance.

If you borrow money to purchase a home or car, or use a credit card to pay for a purchase, you create an unconditional personal duty to pay back what you have borrowed. If you don’t pay, the home lender can generally take away your home, or the car lender can generally take away your car. The credit card company can usually collect their money by seizing your property or your wages.

A lawsuit advance doesn’t saddle you with an unconditional duty to pay. If you don’t recover any money on your case, you have no duty to pay us anything. If you've lost your case, we've lost our money, and we have no right to take your property or your wages.

Do I have to pay fees or make any payments before I receive my settlement?

No. Not even $1 will be paid to us before your case is settled. We know that you cannot afford to make payments along the way.

Is a lawsuit cash advance expensive?

FairWorth provides some of the lowest rates in the lawsuit funding industry. We offer a lowest price guarantee. At the same time, lawsuit funding is expensive compared to home loans, car loans, credit card loans, and many other kinds of financing. The reason is that you don’t have to repay anything unless your case is successful.

We have several recommendations to hold the cost down. First, please only take a lawsuit advance if you urgently need the money. If you can get by without the money, you are better off doing so.

Second, if your need is urgent, please try other sources first. If there is still unused borrowing power on your credit card, now is the time to use it. See if you can borrow on your house or other property. See if you can borrow from family or friends. You’re probably used to being self-sufficient and proud of it, but most of us need help from family and friends at some time in our lives. Don’t let pride or embarrassment hold you back from asking for their help. Please think of a lawsuit advance as a last resort.

Third, please take cash advances as slowly as you can. Ask yourself if you can get by if you receive the money in several installments. That way, you minimize the funding charges. It’s better to take $1,000 per month for five consecutive months than to take $5,000 from the start. FairWorth will pre-approve you to receive cash installments. We want you to get your needs met in the least expensive way.

Will I get approved for the cash advance?

To find out, please call us toll-free at (877) 258-6037 or fill out our easy online application.

How long will it take for me to get the money?

No one works faster than FairWorth. We offer a speedy processing guarantee. We approve most applications with regard to simple cases the same day that your attorney sends the information we need and answers any questions that we have. When your application is approved, we fax the advance contract to your attorney within two hours after approval. If your attorney faxes us a properly executed cash advance contract before 4:00 P.M. Eastern Time, there is a 90% chance that we can wire transfer money that same day into the bank account of your choosing. We guarantee that the money will arrive in the bank account the following day. We can also overnight you a check, but wire transfers are faster, and there is no delay in withdrawing the cash.

Are there any restrictions on what I can use the money for?

You may use the money for any reason or purpose. We only recommend cash advances for urgent needs.

What happens if I don’t recover money on my case?

If you don’t recover any money, you will never have to pay us anything. We will just be out the money, and will never pester you for payment.

[Back to List of Questions]

If I have already received a cash advance from another funding company, can I get more money from your company?

We can sometimes approve a second cash advance after you have received money. From another funding company. It depends on the details of your case, especially its likely settlement value.

[Back to List of Questions]

What are the lowest and highest amounts of money I can receive?

We make advances as small as $200, although we discourage them, because our minimum charges make them very expensive. So far as the largest advance available, no request has ever been declined because it was too large. The size of the advance is tied to the strength and projected value of the case. Because of the cost of lawsuit funding, we highly recommend that you take only what you urgently need.

[Back to List of Questions]

What if I have bad credit or no credit?

We don’t even check your credit. A lawsuit advance is not a loan and is not based on the strength of your credit. Approval is based strictly on the strength and value of your case.
